This statement explains the position of GagTheGirl.net (the “Site”) under 18 U.S.C. § 2257, 18 U.S.C. § 2257A and their implementing regulations at 28 C.F.R. Part 75 (together, the “Record-Keeping Requirements”).
GagTheGirl is not a “producer”, whether primary or secondary, of any visual depiction displayed on the Site, as those terms are defined in 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75. All depictions on the Site are promotional material created and supplied by third parties. Those third parties are responsible for creating and maintaining the records required by the Record-Keeping Requirements.
1.Exemption From Record-Keeping Requirements
GagTheGirl does not produce any content. We do not hire, contract for, manage or otherwise arrange for the participation of any performer, model or other person depicted. We do not photograph, film, record, draw, digitise or otherwise create any of the depictions that appear on the Site, and we do not alter the sexually explicit content of any depiction.
Our activities consist of promoting, linking to and displaying promotional material (clips, previews, trailers, images and comics) that third-party studios, producers, creators and artists make available for promotional purposes, often through affiliate programs and third-party content platforms. To the extent that any of this material falls within the Record-Keeping Requirements at all, these activities do not make us a primary or secondary producer and fall within the exclusions in 18 U.S.C. § 2257(h)(2)(B) and 28 C.F.R. § 75.1(c)(4) for distribution, hosting, transmission, storage and similar activities that do not involve the hiring, contracting for, managing or otherwise arranging for the participation of the persons depicted.
Visual depictions that do not contain actual sexually explicit conduct, simulated sexually explicit conduct or the lascivious exhibition of the genitals or pubic area, as defined by law, are outside the scope of the Record-Keeping Requirements altogether.
Drawn comics and illustrations on the Site are fictional artwork created by third-party artists. They are not photographs, films or recordings of real persons, and their characters are fictional adults aged 18 or older.
2.Third-Party Content and Responsibility for Records
All visual depictions on the Site are provided by, and remain the responsibility of, the studios, producers, creators and artists who made them. Each of those parties is solely responsible for:
- verifying the identity and age of every person depicted before production;
- obtaining and documenting the consent of every person depicted;
- creating, maintaining and making available the records required by the Record-Keeping Requirements, where applicable; and
- publishing the required compliance statement or custodian of records information in connection with its content.
The material we promote is made available through third-party platforms that review content under their own policies, which typically include verifying the age and identity of persons depicted and requiring producers to keep records of consent. We rely on those producers and platforms for that compliance.
3.How to Obtain Records Information
GagTheGirl does not hold, and is not required to hold, records for the depictions shown on the Site. Requests to inspect records should be directed to the producer of the depiction concerned.
- Identify the studio, producer or creator of the material. Their name is normally shown with the clip, image or comic on the Site or on the linked third-party page.
- Follow the link to the producer’s own website or store page, where their 18 U.S.C. § 2257 compliance statement and custodian of records information are available.
- If you cannot identify the producer of a particular depiction, email us with the URL and we will tell you, as far as we know, who supplied it.
4.All Persons Depicted Are Adults
All persons who appear in any visual depiction on the Site were at least 18 years of age at the time the depiction was created. All characters in drawn comics and illustrations are fictional adults aged 18 or older.
GagTheGirl has zero tolerance for any material depicting, involving or appearing to involve minors, and for any non-consensual material. Any such material reported to us will be removed promptly. Suspected child sexual abuse material will be reported to the appropriate authorities, and we will stop promoting the source concerned.
5.Reporting Concerns and Removal Requests
If you believe that any material on the Site depicts a person under 18, was produced or distributed without the consent of everyone depicted, or otherwise does not comply with the law, email [email protected] with the subject line “Content Report” and the URL(s) concerned. If you are a person depicted and want material removed, use the subject line “Removal Request”.
Reports about suspected minors or non-consensual material are given priority, and we disable access to the material while we review it. Full details are in the reporting section of our Terms of Service.
